Swimming Pools

Pools typically require a building permit, electrical permit and zoning approval.  The City does it's best to be reasonable in that we understand that there are now temporary pools that can be installed for a limited amount of time. Regardless of the temporary or permanent nature of a pool (is a building permit required) all pools should meet the following zoning and safety standards:
  • No pool is permitted to project into the front yard area
  • Pools should be at least 8 feet from a side and rear property line. This includes walks, paved areas or accessory structures. If you own a corner lot, the street side of your lot requires a 25 foot setback.
  • Clearence in any direct from overhead wires to the water level, edge or water surface or base of a diviging platform shall be a minimum of 22.5 feet. 
  • Installation of a pool may impact your property assessment and the real estate value is based on size and construction.
  • Pools with a depth in excess of 24" of water must provide a barrier that complies with the Michigan Residential Code. The variables and cirumstances involved with the installation of pools, spas and hot tubs are individual and unique. Each installation should be reviewed by the code Official on a case by case basis prior to the commencement of work. 
  • General barrier guidesles require that they be a minimum of 48 inches above the adjacent grade or an approve cover. Pool side walls may serve as a barrier if at least 48 inches above adjacent grade. Barriers should be solid or have properly spaced spindles, pickets or wire mest. Pedestrian gates need to be self-closing and self-latching. Access gates need to be locakable. When the wall of a structure serves as all or part of a barrier, the wall and any opening needs to comply with the items above.
Applicable Zoning Regulations:
Section 5.22(4) of Chapter 51 of the City Code - Private swimming pools. A private swimming pool, as regulated herein, shall be any pool, pond, lake or open tank, not located within a completely enclosed building and containing or normally capable of containing water to a depth at any point greater than 24 inches. No such swimming pool shall be allowed in any District except as an accessory use and unless it complies with the following conditions and requirements:
(a) The pool is intended and is to be used solely for the enjoyment of the occupants of the principal use of the property on which it is located.
(b) It may not be located, including any walks or paved areas or accessory structures adjacent thereto, closer than eight (8) feet to any property line of the property on which it is located.
